Proposed Christchurch Replacement District Plan
Introduction
The Christchurch Replacement District Plan (which includes Banks Peninsula) was notified on 27 August 2014. Submissions on Stage 1 close on 8 October 2014.
Stage 1 covers ‘matters of priority’ for earthquake recovery and rebuilding i.e. objectives, policies and rules for natural hazards, subdivision, most residential, commercial and business areas, transport and contaminated land. Stage 2 will cover all other parts of the District Plan and will follow in 2015. The Replacement Plan can be found here.
A streamlined hearing process applies. Submissions will be heard by an independent panel with decisions issued by 25 February 2015. There will be no appeal rights, other than on points of law.
How Am I Affected?
The District Plan Review is a very significant document which will determine the land use rules that will apply in the City and Banks Peninsula areas. The Review is an opportunity to request changes that may assist your property interests/aspirations e.g. rezoning from residential to business purposes; intensification of residential activity or dealing with zoning ‘anomolies’. It is also critical to ensure that the new rules do not place new and unreasonable restrictions on your development rights, or equally liberalise development standards that could adversely affect you e.g. controls in new more extensive flood management areas, restrictions on office activity.
Note: the District Plan must give effect to the Canterbury Regional Policy Statement. The RPS has identified new areas for greenfield business and residential growth. Additional areas are unlikely to be zoned through the District Plan Review, unless of a relatively minor nature or to deal with zoning anomolies.
